What Is the Gable Steveson Loophole? Everything to Know About the 2019 Case
On the night of June 15, 2019, Minneapolis police arrested 19-year-old Gable Steveson and his teammate Dylan Martinez. Both men were booked into the Hennepin County jail on probable cause of criminal sexual conduct. A woman had contacted authorities alleging that she had been sexually assaulted after a night of heavy drinking, prompting an immediate investigation by local law enforcement and athletic department administrators.
The University of Minnesota promptly suspended both athletes from team activities pending the inquiry. For six months, the case hung over the wrestling program. Then, in December 2019, Hennepin County Attorney Mike Freeman released an official statement declining to bring formal charges against either Steveson or Martinez.
Freeman’s office noted that investigators had conducted an exhaustive review of forensic evidence, surveillance footage, witness statements, and electronic communications. Prosecutors concluded there was "insufficient evidence to prove beyond a reasonable doubt" that a crime occurred. While defense attorneys insisted the encounter was consensual, legal scholars pointed directly to the archaic language governing sexual assault statutes in Minnesota, which severely tied prosecutors' hands whenever the alleged victim consumed alcohol willingly.
